Please be informed that we will only collect, use, and store your personal data in alignment with the revised agreement once you have clicked the agree button in the pop-up. PicAIService DetailsPicAI The specific offerings of PicAI are determined by its operators and may include, but are not limited to, screen recording and video editing. PicAI's operators reserve the right to upgrade or adjust their services or products, updating the app accordingly. By using PicAI, you agree that we, either on our own or via third-party advertisers, may send you ads, promotions, or promotional content (both commercial and non-commercial). The mode and scope of this may vary without notice. While PicAI may offer options to disable ad notifications, at no point should you attempt to block or filter ads in ways not explicitly stated or authorized in writing in this user agreement. PicAI is legally obliged to fulfill its responsibilities to advertisers. It's up to you to verify the accuracy of ads, and you assume responsibility for any dealings with advertisers. You understand that PicAI may need to carry out regular or ad-hoc maintenance or repairs on product-related facilities. If this results in service interruptions within reasonable limits, PicAI will not be held liable. We reserve the right to suspend any portion of the service for maintenance, upgrades, or other purposes without prior notice. 2. PicAIService UsagePicAI Unless explicitly stated in this agreement, no part of the application or its content can be replicated, copied, reproduced, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other person, server, website, or other medium for publication or distribution or for any commercial enterprise, without Apple’s express prior written consent. You bear full responsibility for the content you post. We do not guarantee the accuracy, completeness, or quality of user content posted by others. You declare and assure that the content you post and your use of the service will not: (1). Harm minors in any way; (2). Intentionally or unintentionally violate or fail to comply with local, national, or international laws; (3). Infringe on the intellectual property rights of any third party; (4). Intimidate, stalk, mock, defame, threaten, or harass others; (5). Overburden, damage, or weaken the functioning of the application, website, or service; (6). Impersonate any individual or entity, or misrepresent your affiliation with anyone or anything; (7). Collect or gather personal information about other users for any purpose, including sending unsolicited emails or messages; (8). Use any intellectual property in the application without explicit permission, unless otherwise stated. During your usage, we may send service announcements, administrative messages, and other information. You may opt out of some of these communications. 3. PicAIPrivacyPicAI We highly prioritize your privacy. We'll gather and store your personal data in accordance with PicAI's privacy policy. Using our service indicates your agreement for us to handle your personal data per our privacy policy. Additionally, by using this application, you acknowledge and agree that no internet transmission is entirely private or secure. You understand that any messages or information you send to the app could be read or intercepted by others, even if there's a special notice that a particular transmission (like credit card information) is encrypted. 4. PicAIContent ResponsibilityPicAI You acknowledge that all information, data, text, software, music, sound, photos, graphics, videos, messages, tags, or other materials accessible via PicAI, whether publicly posted or privately transmitted (“Content”), are the sole responsibility of the person from which such Content originated. PicAI merely offers tools for screen recording and video editing and has no control over how you utilize these services. Thus, we don't guarantee the accuracy, completeness, or quality of Content. PicAI will not be held responsible for any Content but reserves the right to stop transmitting any such Content and take legal measures if necessary. PicAICost and Subscription TermsPicAI PicAI offers a range of subscription options to best meet your needs. You can choose to subscribe to our premium version to access advanced services and content. Our fees vary based on different subscription plans, gift plans, and promotional activities, so we reserve the right to update our fees from time to time. You acknowledge that if we change our fees, it will not affect your current subscription. Therefore, if you have registered for a subscription at a particular fee, any fee changes will not affect any current subscription or any renewal. Please note, if you purchase a subscription through Apple iTunes or the PicAI app, the following terms apply: (1) PicAISubscription ConfirmationPicAI: The fee will be charged to your iTunes account upon confirmation of purchase. (2) PicAISubscription ManagementPicAI: Users can manage or cancel their subscription in the iTunes & App Store account settings on their mobile devices. (3) PicAIAutomatic RenewalPicAI: The Apple iTunes account will be charged for renewal within 24 hours before the end of the current subscription period. To cancel the renewal, turn off automatic renewal manually at least 24 hours before the end of the term. Cancellations of the current subscription are not allowed during an active subscription period. (4) PicAIFree TrialPicAI: The free trial, if offered, will automatically upgrade to the professional version upon expiry. You can cancel the renewal in "Account Settings" before the trial ends. If you subscribe to the premium version before the trial ends, the current trial will automatically terminate. 6. PicAIModification and Termination of Our ServicePicAI You understand and agree that the PicAI service is provided based on current technologies and conditions. The platform will make every effort to provide services to users, ensuring consistency and security; however, PicAI cannot foresee and guard against legal and technical risks, including but not limited to force majeure, viruses, Trojans, hacker attacks, system instability, defects in third-party services, government actions, etc., which may cause service interruption, data loss, and other losses and risks. We continuously change and improve our services. We might add or remove features or capabilities, and we might suspend or stop a service altogether. You may stop using our services at any time, though we would be saddened to see you go. PicAI might also stop providing services to you or add or create new limitations to our services at any time. If we have reason to believe you've violated this agreement or acted inconsistently with its terms, we reserve the right to modify, temporarily suspend, or permanently delete your account and terminate your access to services. After termination, your permissions will automatically be revoked. We reserve the right to delete your account, remove all or any information from your profile, and discard any of your user content. You agree we're not liable for any modification or interruption of the service or for removing information or content from your profile. You acknowledge and accept that certain user content may remain after your account is terminated and that user content licenses aren't revoked or terminated. If we terminate your account when you have a valid premium subscription, 7. PicAIDisclaimerPicAI PicAI will make reasonable efforts to provide services and ensure their continuity and security. However, PicAI does not offer complete guarantees, including but not limited to: (1) PicAI is not responsible for the deletion or failure of data stored in software and services. (2) When using this application, users should assume risks beyond PicAI's control, including but not limited to: (3) Risks due to unstable wireless network signals, limited wireless network bandwidth, or other reasons causing inability to log into PicAI, incomplete data synchronization, slow page loading, etc. (4) Risks of personal information loss or leakage due to irresistible factors; (5) Any problems or damages caused by the user not selecting the software version that matches the terminal equipment installed with this software; (6) Any risks or liabilities caused by others transmitting or sharing content published by the user; You understand and agree that PicAI does not promise that this application or website's content, services, or features will be error-free or uninterrupted, or that any defects will be corrected, or that your use of this site will provide specific results. The app and its content are delivered on an "as-is" and "as-available" basis. There are no warranties, either expressed or implied, including any about accuracy, non-infringement, merchantability, and fitness for a particular purpose. All information provided in the application is subject to change without notice. 8. PicAILiability LimitationPicAI To the extent permitted by law, PicAI is not liable for lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary, or punitive damages. In all cases, we won't be liable for any loss or damage that isn't reasonably foreseeable. Within the limits of the law, our total liability for any claim under this agreement, including any implied warranties, is limited to the amount you paid us to use the services (or, if we choose, to supplying you the services again) and won't exceed the total of any subscription or similar fees with respect to any service or feature of the application paid in the six months prior to the date of the initial claim made against PicAI. 9. PicAIGeneral InformationPicAI This agreement and PicAI's privacy policy control the relationship between PicAI and you. They don't create any third-party beneficiary rights. If you don't comply with this agreement and we don't take action immediately, it doesn't mean we're waiving any rights we might have (like taking action in the future). If it turns out that a particular term isn't enforceable, it won't affect any other terms. The establishment, effect, performance, interpretation, and dispute resolution of this agreement are governed by the laws of mainland China, without regard to conflict of law principles. If there's any dispute between you and PicAI, it should first be resolved through negotiation; if negotiations fail, you agree to submit the dispute to the People's Court. The titles in this agreement are for convenience only and have no actual significance. They shouldn't be used as a basis for interpreting the agreement's meaning.
